Somasundaram alias Somu v. State Represented by Deputy Commissioner of Police [2020] 

A three bench of the Hon'ble Supreme Court while hearing the case referred to it following a split verdict by a division bench upheld the conviction for the abduction and murder of Tamil Nadu politician, M K Balan in 2001 by applying the principle that in a case of abduction followed by murder, the abducter can be presumed to be the murderer, and that Section 106 of the Evidence Act would come to the assistance of the prosecution. It also held that where abduction is followed by illegal confinement and still later by death, the inference becomes overwhelming that the victim died at the hands of those who abducted/confined him. The Court referred to the following precedents:

  • Sucha Singh v. State of Punjab AIR [2001 SC]
